South Dakota special assessments: what your board must do.
SD's condo chapter says nothing on assessments; it mostly covers developer filings.
Does the board need an owner vote?
South Dakota's condominium chapter (SDCL 43-15A) has no section on special assessments, budgets or owner votes. It sets up how a condo is created by a recorded master deed or lease and how developers report to the Real Estate Commission. This summary covers only that chapter, so rules on assessments would have to come from other law.
S.D.C.L. ch. 43-15A; 43-15A-3What notice must owners get?
Owners are usually entitled to written notice that states the amount, the purpose and the due dates. Many states also require the board meeting where it was approved to be open to owners and noticed in advance.
Your right to see the records
Owners generally have a legal right to inspect and copy the association's records, including the budget, reserve study, contracts, bids and minutes. Ask in writing and keep proof that you sent it.
Payment plans, late fees and liens
Unpaid assessments usually lead to late fees, interest and a lien.
In South Dakota, the same rules cover condos and HOAs.
