Missouri special assessments: what your board must do.
Missouri condo owners can reject a proposed budget by a majority of all owners.
Does the board need an owner vote?
For condominiums created after 28 September 1983, the board must send owners a budget summary within 30 days of adopting the budget and set an owners' meeting 14 to 30 days after mailing it. The budget stands unless a majority of all unit owners (or a larger vote your declaration sets) rejects it. This section sets no separate owner vote for a special assessment, so check your declaration and bylaws.
RSMo 448.3-103(3)What notice must owners get?
For condominiums created after 28 September 1983, the association must give notice of any owners' meeting at least 10 and no more than 60 days ahead, by hand delivery or prepaid mail. The notice must state the time, place and agenda, including any budget changes.
RSMo 448.3-108Your right to see the records
For condominiums created after 28 September 1983, all financial and other association records must be made reasonably available for examination by any unit owner and the owner's authorized agents. The statute sets no deadline for the association to respond.
RSMo 448.3-118Payment plans, late fees and liens
Interest on past-due assessments is capped at 18% a year, and the association has a lien on your unit from the time an assessment is due; these sections also reach older condos for later events. The association can recover collection costs and reasonable attorneys' fees, and the lien ends unless enforcement starts within three years after the full amount is due. The sections cited set no payment-plan right.
RSMo 448.3-115(2); 448.3-116In Missouri, the same rules cover condos and HOAs.
