Iowa special assessments: what your board must do.
Condo bylaws must require 7 days' notice of board meetings; liens outrank most others.
Does the board need an owner vote?
Iowa's Horizontal Property Act (chapter 499B) sets no owner vote on assessments. It only requires the bylaws to cover the manner of collecting owners' share of common expenses and the method of approving payment vouchers.
Iowa Code 499B.15(4)-(5)What notice must owners get?
If your condo is run by a board of administration, the bylaws must provide that notice of each board meeting is mailed or delivered to every owner at least seven days ahead. Board meetings must be open to owners, except meetings between the board and its attorney about proposed or pending litigation. A board action taken at a meeting that breaks these rules is not valid or enforceable.
Iowa Code 499B.15(2)Your right to see the records
If your condo is run by a board of administration, the bylaws must provide that the board's official records are open to inspection and available for photocopying at reasonable times and places. The section sets no deadline for the association to respond.
Iowa Code 499B.15(2)Payment plans, late fees and liens
Unpaid assessments are a lien on your unit ahead of all other liens except tax liens and a first mortgage of record. The council of co-owners can foreclose the lien by suit like a mortgage, or sue for a money judgment without giving up the lien. Chapter 499B sets no late-fee or interest cap, no notice period before foreclosure and no payment-plan right.
Iowa Code 499B.17In Iowa, the same rules cover condos and HOAs.
